Alternative Dispute Resolution
Businesses and individuals involved in civil disputes are faced with the delay, the uncertainty and both the obvious and the hidden costs of litigation. Holmstrom & Kennedy’s litigators have been leaders in recognizing the impact of these factors on our clients and on our society, as well as in the search for better solutions. We have extensive experience participating in ADR on behalf of our varied clientele, as well as serving as the neutral or decision-maker. We encourage our clients to evaluate alternatives to litigation early and provide assistance to those for whom those alternatives are likely to be beneficial.
Mediation
A trained mediator does not serve as a judge or decision-maker, but brings the parties together and works with them to arrive at a resolution of the dispute which is acceptable to all sides. The process has proven surprisingly successful in resolving disputes, and Holmstrom & Kennedy attorneys are experienced both in representing individuals and businesses in mediations and serving as mediators to assist non-clients to resolve their disputes.
Arbitration
Arbitration is a process whereby one to three lawyers serve, in effect, as judges. The arbitration hearing is typically much shorter and more efficient than a full-blown trial and, as a consequence, less expensive for the parties. Many insurance policies and business agreements require arbitration. Civil lawsuits in Illinois where less than $50,000 is in dispute are generally required to go to arbitration before a panel of three lawyer arbitrators. In other instances, the parties simply agree to arbitrate. Our attorneys have broad experience in advising clients about arbitration and representing them in arbitration hearings, as well as serving as arbitrators.
